General Terms and Conditions (GTC)

1. Scope and Contracting Party

These General Terms and Conditions (“GTC”) govern all contracts between:

(“we,” “our,” or “Traders AID”)

and individuals or businesses (“you” or “Customer”) purchasing access to our digital product via our website www.traders-aid.com.

These GTC apply in the version valid at the time of your order. Deviating terms and conditions submitted by you shall not apply unless explicitly accepted by us in writing.

These GTC apply to both consumers and businesses. Consumers are natural persons who act for purposes not related to their trade, business, or profession. Businesses are legal or natural persons acting in the course of their business. Our services are only offered to Customers who are of legal age and reside in Switzerland or the European Union.

The contract language is English.

 

2. Conclusion of Contract

The presentation of the product on our website does not constitute a legally binding offer but an invitation to place an order.

You submit a binding offer to purchase our product by completing the Stripe checkout process and confirming payment. Upon successful payment processing, you will receive an order confirmation. A contract is formed when we send confirmation of access or deliver the necessary integration details for using the product.

We reserve the right to reject an order without providing a reason, especially, but not limited to, in case of suspicion of misuse, fraud, or payment irregularities.

 

3. Description of Service

Traders AID offers a technical indicator as a digital product, intended for use in financial market analysis. The indicator is delivered in a non-physical format and integrated by you into your compatible trading or charting environment.

We currently offer two types of subscription:

  • Monthly access
  • Annual access

Each subscription grants you a limited right to use the indicator for the subscription duration.

You are responsible for the technical integration of the product into your own platform. No installation, customization, or advisory service is included unless explicitly stated.

We may enhance the service or platform in the future, including features such as AI-based insights or user dashboards, but these are not part of the current subscription scope.

 

4. Prices and Payment

All prices listed on our website are final prices and include any applicable value-added tax (VAT), unless otherwise noted.

Available payment methods are shown during the checkout process. Payment is processed via Stripe, a certified third-party provider. We do not store payment data.

The full subscription fee is payable in advance. You authorize Stripe to charge the applicable amount at each renewal date (monthly or annually, as selected).

Discount codes, if applicable, must be used before completing the checkout process. Retroactive application is not possible.

In case of failed or reversed payments, access may be suspended, and additional fees may apply. Delays may result in interest charges in accordance with applicable law (default interest of 5% per annum in Switzerland).

 

5. Subscription Renewal and Cancellation

Your subscription will renew automatically at the end of each term (monthly or annual), unless you cancel before the renewal date.

Cancellation can be made directly via the link in your original Stripe confirmation or by contacting us at info@traders-aid.com at least 48 hours before the next renewal.

No partial refunds are issued for early termination. Cancellation only takes effect at the end of the current billing cycle.

We reserve the right to cancel your subscription with immediate effect in case of breach of these GTC or unlawful use of the product.

 

6. Rights of Use

Upon full payment, you receive a limited, non-exclusive, non-transferable right to use the digital indicator solely for your personal or internal business use, for the subscription duration.

You may not:

  • Share, resell, sublicense, or distribute the product
  • Decompile, reverse-engineer, or modify the code
  • Provide third-party access to the product
  • Use the product in violation of applicable laws or regulations

All intellectual property rights remain with Traders AID or our licensors.

 

7. Availability and Changes

We aim to ensure the product remains technically usable throughout the subscription period. However, availability may be temporarily limited due to maintenance, software updates, third-party service issues, or force majeure.

We may improve, modify, or discontinue parts of the product to adapt to legal, technical, or commercial developments, provided this does not materially impair the value of the subscription.

Substantial changes will be announced in advance. If changes significantly reduce functionality, you may cancel the subscription before the change takes effect.

 

8. Warranty

Our digital product is provided “as is” and, to the extent permitted by law, we disclaim all warranties or guarantees beyond those expressly stated.

Although we strive to ensure the highest possible availability of the products at all times and take all reasonable measures to this end, uninterrupted availability cannot be guaranteed.

We make no guarantee regarding specific trading outcomes, performance, or compatibility with all platforms.

You must notify us of defects promptly after discovery. Warranty rights are limited to what is required under applicable Swiss law.

 

9. Liability

We are liable for damages only in cases of willful misconduct or gross negligence.

For all other damages, including loss of profits or data, our liability is excluded to the maximum extent permitted by law. To the extent permitted by law, we exclude all liability — including liability for our vicarious agents and subcontractors. This exclusion applies to both contractual and non-contractual claims made by the User. All claims shall expire after 6 months.

To the maximum extent permitted by law, we disclaim all liability for any loss or damage arising out of or in connection with the use of, or reliance on, any third-party service, whether directly or indirectly linked to or accessed through our products (e.g. Stripe). The Customer uses such third-party services at his own risk and is solely responsible for ensuring their suitability and compliance with applicable laws and regulations.

Where liability cannot be excluded, it is limited to the subscription fees you paid in the 12 months prior to the incident.

These limitations also apply to our agents, employees, and legal representatives.

 

10. Data Protection

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). Details are available in our Privacy Policy, which is an integral part of these GTC. The currently published Privacy Policy available on our website shall apply at all times.

 

11. Amendments & Assignment

We reserve the right to update these GTC to reflect changes in legal requirements, technology, or service structure.

You will be notified of changes by email. If you do not object within 30 days, the changes are considered accepted. If you object, we may terminate your subscription at the end of its term under the previous version of the GTC.

Assignment and Transfer of Contractual Relationship

In the event of a merger, acquisition, corporate reorganization, sale of all or substantially all of the assets, spin-off, or any other form of transfer of ownership or control of Traders AID, the contractual relationship between Traders AID and the Customer — including all rights, obligations, and entitlements arising therefrom — shall automatically transfer to the acquiring or succeeding entity without requiring the Customer’s prior consent.

 

12. Governing Law and Jurisdiction

These GTC shall be governed by and construed exclusively in accordance with the laws of Switzerland, excluding conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any dispute, controversy, or claim arising under, out of, or relating to these GTC shall be referred to and finally determined by the competent courts located at the registered office of the the Traders AID, currently in Canton Zürich, Switzerland, to the exclusion of any other jurisdiction.

If any provision of these GTC is found to be invalid, the remaining provisions shall remain effective.
